Lifetime Plant Warranty

When you hire Mazelis Landscape you can trust that the job will be done professionally and the plants and materials used are of the highest quality.  But our guarantee  does not stop there.  We want you to take comfort in knowing that you’ll be able to enjoy your new landscape for years to come.  That’s why we offer a transferable lifetime warranty on installed trees, plants and shrubs for as long as you hold a maintenance contract with us.  Here’s how it works:

To qualify for Lifetime warranty, plantings must me designed, installed and maintained (for the life of the warranty by Mazelis Landscape. Maintenance shall include all of the following: plant health care, spring cleaning, monthly bed maintenance (weeding), annual mulching, irrigation maintenance, and pruning.

With this unique warranty there are a few exclusions for plants that are not reliable enough such as annuals, perennials, and ground cover material (including sod or seed lawns). The guarantee does not cover transplanted plant material, plants in pots, plants in berms (raised beds) or raised planter boxes. Plant material guarantee does not extend to damage resulting from vandalism, improper watering, poor drainage, extreme cold, salt damage, natural catastrophe, disease or insect damage, Owner / Agent neglect, “acts of God,” and other factors beyond the control of the Mazelis Landscape.

Mazelis Landscape will perform replacements on a one-time basis only at the request of the Owner / Agent. If replacing a plant becomes necessary, such replacements shall consist of reasonably similar plant material that is available to be purchased by Contractor within a 10-mile radius of Contractor’s business office. If replacements that are reasonably similar to the plant materials are not available to the Mazelis Landscape within such 10-mile radius, Mazelis Landscape shall have the discretion to install replacements that industry custom would deem to be the next-best available option within such 10-mile radius. Plants will be replaced with a new plant representing its original planted size.

Notwithstanding any contrary provision, Mazelis Landscape shall not be obligated to perform any of the work/services contemplated by the foregoing Warranties unless Owner/Agent has paid in full all amounts due to Mazelis Landscape for all work/services previously rendered by Contractor.  Refunds are not given in lieu of warranty replacement. Cancellation for any reason of maintenance by the Owner / Agent or Mazelis Landscape will immediately void the lifetime warranty.

The First Year Plant Warranty

With respect to certain plant materials (such as shrubs and trees) installed by Mazelis Landscape, Mazelis Landscape provides a limited guarantee provided the Owner / Agent has provided proper horticultural care for the plant material since installation by Mazelis Landscape. Mazelis Landscape will perform replacements on a one-time basis only at the request of the Owner / Agent. Plant material guarantee does not extend to damage resulting from vandalism, improper watering, poor drainage, extreme cold, salt damage, disease or insect damage, Owner / Agent neglect, “acts of God,” and other factors beyond the control of Mazelis Landscape.  Accordingly, with respect to such plant materials, Mazelis Landscape guarantees them for one-year after the date of their installation; provided that (1) during such one-year period the Owner / Agent notifies Mazelis Landscape before 20% or more of such plant materials are considered to be dead (under common landscaping industry custom). In such case, Mazelis Landscape will use commercially reasonable efforts to revive such plant material. Only after 50% or more of such plant materials considered to be dead (under common landscaping industry custom) shall Mazelis Landscape be obligated to replace such plant materials. In such case, such replacements shall consist of reasonably similar plant material that are available to be purchased by Mazelis Landscape within a 10-mile radius of Mazelis Landscape’s business office. If replacements that are reasonably similar to the plant materials are not available to Mazelis Landscape within such 10-mile radius, Mazelis Landscape shall have the discretion to install replacements that industry custom would deem to be the next-best available option within such 10-mile radius. Mazelis Landscape does not offer a guarantee on transplanted plant material, plants in pots, or raised planter boxes. With respect to annuals, perennials and ground cover materials (such as sod or seed lawns) installed by Mazelis Landscape, Mazelis Landscape does not provide any guarantee. Mazelis Landscape will guarantee proper installation of annuals, perennials and ground cover materials. Any unpaid money due from Owner / Agent to Mazelis Landscape voids all warranties. Refunds are not given in lieu of warranty replacement. Cancellation for any reason of maintenance by the Owner / Agent or Mazelis Landscape will immediately void the lifetime warranty. Notwithstanding any contrary provision, Mazelis Landscape shall not be obligated to perform any of the work/services contemplated by the foregoing Warranties unless Owner/Agent has paid in full all amounts due to Mazelis Landscape for all work/services previously rendered by Contractor. Masonry Five Year Warranty

With respect to masonry services performed by Mazelis Landscape, Mazelis Landscape guarantees the workmanship of such services for five-years after the date they are substantially completed. All materials used by Mazelis Landscape in connection with such masonry services are subject to the applicable manufacturer’s warranty. If any manufacturer provides to Owner / Agent any substitute or replacement masonry materials pursuant to such manufacturer’s warranty on such masonry materials, Mazelis Landscape shall not be responsible for installing such substitute or replacement materials nor for extracting any of the original masonry materials that Mazelis Landscape installed previously. Mazelis Landscape disclaims any liability in connection with or arising from any other person’s implementation, installation, and/or modification of any materials delivered to Owner / Agent and/or the results of the services that were provided by Mazelis Landscape.

With respect to poured concrete performed by Mazelis Landscape,cracks or other blemishes in poured concrete are inevitable and regardless of the quality of the workmanship Mazelis Landscape does not and cannot in any way promise or guarantee anything to the contrary.
